10-Year Sofa Frame Guarantee Terms and Conditions
Thank you for choosing The Sofa Company. We stand behind the quality and construction of our sofas and recliner sofas. This guarantee provides assurance specifically concerning the internal structural frame of your new furniture.
1. Guarantee Coverage

- This guarantee strictly covers the internal structural frame of sofas and recliner sofas purchased directly from The Sofa Company within the United Kingdom. This is the wooden or metal skeleton of the sofa that provides its primary support.
- The guarantee is valid for a period of 10 years, commencing from the date of delivery to the original purchaser.
2. Explicitly Covered Defects

- This guarantee solely covers defects in the internal structural frame that directly compromise the sofa's primary structural integrity and its ability to safely and effectively support its intended load under normal domestic use.
- Covered defects are limited to:
- Complete breakage of a frame component rendering the sofa unusable.
- Separation of frame joints that results in a significant loss of structural stability.
- Warping or distortion of the frame exceeding 1cm which causes the sofa to become structurally unsound or unsafe for normal use
3. Exclusions – What is NOT Covered

- To provide absolute clarity, this guarantee explicitly excludes, without limitation:

Any and all upholstery materials, including fabric, leather, vinyl, and other coverings.

Any and all foam, fillings, padding, wadding, or cushioning materials used in the sofa.

Any and all springs, webbing, elastic supports, or other suspension systems.

Any and all recliner mechanisms, electrical components, or moving parts in recliner sofas. These may be covered under separate, limited warranties.

This guarantee does not cover items that fall into the following product categories; Tub Chairs, Dining Chairs, Swivel Chairs, Ottomans or Coffee Tables

Cosmetic imperfections of any kind, including but not limited to:
- Variations in wood grain or colour.
- Minor scratches or blemishes present at the time of delivery.

Normal wear and tear, which is defined as the expected degradation of materials and components over time with regular use. This specifically includes:
- Fading, stretching, or pilling of upholstery fabrics.
- Compression or flattening of cushions and fillings.
- Loosening of seams or buttons.
- Minor squeaks or noises from the frame or other components.

Damage resulting from:

Misuse, abuse, or neglect, including but not limited to:
- Using the sofa in a manner inconsistent with its intended purpose (e.g., standing or jumping on it).
- Exposing the sofa to excessive weight or stress beyond normal domestic use.
- Failure to properly clean and maintain the sofa according to The Sofa Company’s recommendations.

Accidents, incidents, or unforeseen events, including but not limited to:
- Spills of liquids of any kind.
- Burns, cuts, punctures, or tears caused by external objects.
- Damage caused by pets or other animals.
- Damage caused by natural disasters (e.g., fire, flood, earthquake).

Environmental factors, including but not limited to:
- Exposure to direct sunlight, extreme heat, or excessive humidity.
- Damage caused by pests or infestations.

Modifications or alterations to the sofa made by the purchaser or any third party.
-
Improper assembly if the sofa was sold as self-assembly and assembled incorrectly.

Use of non-approved cleaning products or treatments.
-
Transportation damage that was not reported at the time of delivery.

Consequential or incidental damages of any kind, including but not limited to:
- Loss of use of the sofa.
- Inconvenience or disruption to the purchaser’s household.
- Damage to other property.
- Emotional distress or mental anguish.

Products sold "as is," "ex-display," or with known defects.

If the furniture has been moved from its original delivery address, unless written authorisation is provided by The Sofa Company.
4. Customer's Responsibility to Prove Frame Failure

It is the sole responsibility of the customer to provide sufficient evidence to The Sofa Company's satisfaction that a defect in the internal structural frame exists and is covered by this guarantee. This evidence must include, without limitation:
- The original sales receipt or invoice as proof of purchase.

Detailed photographic evidence clearly showing the nature and extent of the defect in the frame. Photographs must be of sufficient quality to allow for proper assessment.
- A written statement describing the circumstances under which the defect occurred.

Expert opinion from a qualified furniture repair technician acceptable to The Sofa Company, at the customer's expense, if requested by The Sofa Company.
5. Claims Process

- To make a claim, the customer must:
- Notify The Sofa Company within 14 days of discovering the suspected defect.
- Provide all required evidence as outlined in Section 4.
- Make the sofa available for inspection by The Sofa Company or its authorised representative, at the customer’s expense, if required. The Sofa Company reserves the right to refuse inspection if the sofa is not in a reasonably clean and accessible condition.
- The Sofa Company reserves the right to:
- Deny a claim if the customer fails to provide sufficient evidence of a covered defect.
- Repair the defective frame (at The Sofa Company’s discretion).
- Replace the defective sofa with the same or a similar model (if the original is no longer available, and at The Sofa Company’s discretion).
- Offer a pro-rated refund based on the remaining life of the guarantee and the assessed severity of the defect (at The Sofa Company’s sole discretion). The pro-rated refund will be calculated based on the original purchase price less a deduction for each year of use, regardless of the actual condition of the sofa.
- Refuse a claim if the defect is not covered by this guarantee or if the terms and conditions have not been fully met.
6. Limitations

- This guarantee is non-transferable.
- The Sofa Company's liability is strictly limited to the repair, replacement, or pro-rated refund of the defective frame only.
- The Sofa Company shall not be liable for any other damages whatsoever.
- The customer is responsible for all costs associated with returning the sofa for inspection, repair, or replacement.
- Any repairs or replacements do not extend the original guarantee period.
7. Legal Rights

- This guarantee is in addition to your statutory rights as a consumer under UK law.
8. Governing Law

- This guarantee shall be governed by and construed in accordance with the laws of England and Wales.
